  • Check your deadline. In the US, if you are 40 or older, federal age-discrimination law (the OWBPA) generally gives you at least 21 days to consider a release — 45 days in a group layoff — and 7 days to revoke after signing.
  • Check for advance notice. Under the federal WARN Act, employers with 100 or more employees generally owe 60 days' notice (or pay in lieu) for mass layoffs and plant closings. Some states have stricter rules.

Taxes and benefits

Severance is taxed as wages. In the US, employers often withhold federal income tax on supplemental pay at a flat 22%, which may be more or less than you eventually owe. Health coverage usually ends at the end of your last month or soon after; COBRA lets you keep the same plan, typically for up to 18 months, but you pay the full premium.
